I have looked carefully at Clause 90, which relates to the features of products. I have looked at it with a view to whether equivalent powers to those that I am proposing will be available using that clause, and I am not persuaded that that is the case. Age-gating technology and the linkage of biometric information to the technology are not, in my view, “the markings on” the product. They are not “information provided” on a vape or, in my view, covered by the appearance, size or shape of the product, which are other features in Clause 90. The only features that remain are
