Why strengthen the independence of the reviewer when it comes to cases brought against civil servants and public officials, but not for the people most directly affected by the exercise of state power; namely, benefits claimants? We hope this omission is simply a drafting oversight rather than a deliberate policy choice, because otherwise the effect would be to create in practice a “one rule for us, one rule for them” approach: a powerful, protected reviewer for the officials, but a weak and constrained one for those on welfare.
