203L: After Clause 48, Insert the following new Clause— “Refusal of certain asylum claims (2)(1) The Secretary of State must declare an asylum claim or a human rights claim made by any person to whom this section applies inadmissible.(2) Subsection (1) applies to a person who—(a) entered the country on a student visa, and(b) made the asylum claim more than two days after entering.(3) A claim declared inadmissible under subsection (2) cannot be considered under the immigration rules.(4) A declaration under subsection (3) that a claim is inadmissible is not a decision to refuse the claim and as such no right of appeal under section 82(1) (right of appeal to the Tribunal) of the Nationality, Immigration and Asylum Act 2002 arises.(5) For the purposes of this section, the Human Rights Act 1998 does not apply.(6) A declaration under subsection (3) is final and not liable to be questioned or set aside in any court.”
