While the matters raised by the amendment are all-important considerations, I hope that noble Lords would agree that these matters are adequately dealt with elsewhere in the legislation. Introducing further legal tests that must be passed to avoid challenge would result in a significant potential cost and delay to EDPs. I hope that the noble Earl will not press Amendment 264.
