I am happy to continue the conversation on this, but I would reiterate that it is up to the developer whether they enter into an EDP. They will have a charging schedule set out before them and, if they feel the contingency is too great, they can argue it or not take part in the EDP. On Amendment 309A, tabled by my noble friend Baroness Young, I reassure my noble friend that the intention of her amendment is already captured. I agree that it is crucial that Natural England ensures the effective delivery of conservation measures, which is why Clause 55 sets out that the conservation measures in an EDP “are to be taken by, or on behalf of, Natural England … to … address the environmental impact of development”, as well as “contribute to an overall improvement in the conservation status of the identified environmental feature”.
