This is for three reasons. First, the higher-tier authority is undefined in practice. The amendment assumes that it is obvious which body is at the higher tier, but the post-devolution environment complicates this. Is it the combined authority, a mayoral development corporation, a county or even a national designated corporation? Without statutory clarity, the amendment shifts the ambiguity rather than resolves it.
