Amendment 211 perhaps may fit better in later groups but is placed in this part of the Bill. My amendment deals with a particular circumstance, where Natural England has attempted to incentivise financially a landowner to undertake an environmental delivery project but the landowner has turned it down, and NE then uses its CPO powers to acquire that land. If the EDP costs more to deliver than the landowner was originally offered, the contract was clearly inadequate and the landowner right to turn it down. In those circumstances, without implying that NE was acting in bad faith by underpricing the contract, it is only right that there should be a sanction on NE, and a return of the land at no cost would appear appropriate.
