If the House were willing to support this amendment, I believe it has several attractive characteristics. First, Natural England would be incentivised to cost an EDP appropriately at inception and build in an appropriate contingency. Secondly, Natural England would be disincentivised from using its CPO powers in all but the most extreme circumstances. I believe that these impacts address the concerns raised in many other amendments in Part 3.
