Clause 71 sets the parameters for how the nature restoration levy can be used; crucially, requiring Natural England to spend money received through the levy on conservation measures that relate to that EDP. We have also built in flexibility for the levy to be collected in a way that reflects the reality of how development occurs. Importantly, regulations can also require the imposition of a condition of development to secure collection of the levy.
