The functions set out in Clause 76 may include the development of land; for example, to create a certain habitat to improve the conservation status of protected sites. There will be instances where it is more prudent, cost effective or timely for another body, whether a public authority or a private business, to carry out certain measures, so this clause gives Natural England that ability. Natural England and the Secretary of State will also, where needed, be able to use power of entry to survey and investigate land subject to appropriate constraints; for example, around timing, restrictions and what the powers can be used for.
