Amendment 239 is a similar amendment, only in this case it addresses the ways in which the development may give rise to negative effects on the environmental feature. Knowing and identifying the effects and how they are caused is an essential precondition of a successful environmental delivery plan. So, again, the words “one or more” in respect of the ways in which the negative effect is likely to be caused seem to be just creating an opportunity for Natural England to leave out relevant aspects of the development and the effects that they might have on the environmental feature. Again, that seems to be wrong. The Bill should really refer to “the ways in which the negative effects are likely to be caused” rather than “one or more ways”.
