Introducing a new test in advance of preparing an EDP is not necessary as a result of the Government’s amendments, to which the noble Baroness referred, which clarify both the process that Natural England will go through when developing an EDP but also the consideration the Secretary of State must go through before deciding whether to approve the EDP.
