In the last group and in this group, the noble Baroness, Lady Young of Old Scone, has talked about the protected feature and protected species. Under the definitions in Clause 92, if one were to take out “protected species” from Clause 55, that would also take out species listed in Schedules 2, 4 and 5 to the habitats regulations 2017 and those protected under Part 1 of the Wildlife and Countryside Act and the Protection of Badgers Act. It would not take out species altogether because, if a protected site has a protected feature, which can mean any habitat or species or assemblage of habitats and species—a point made by the noble Baroness on the previous group—that can be part of the process of its being designated as a European site, an SSSI, a Ramsar site et cetera. The species may still be included by virtue of forming part of the protected feature. One has to be clear about what one is keeping in and taking out.
