A disproportionate use of these powers will be unlawful if exercised in a way that is incompatible with convention rights. I refer noble Lords to what was said by the then Minister Angela Eagle in the House of Commons during Committee on this Bill. As the policy Minister responsible for this area in the Commons at the time, she said that the powers will be applied only in a very low number of cases
