This amendment would make it unlawful for a landlord to accept an offer from a prospective tenant to provide a guarantor in a very broad set of circumstances, including in the case of any tenant who has paid a tenancy deposit. We must not underestimate the risk that such action would pose to those who rely on guarantors to access the private rented sector. Without the option of providing a guarantor, many prospective renters, including those moving out of home for the first time, the self-employed and those with historic debts, would find it difficult to secure a private tenancy, and some would find it impossible.
