There is a background to this. Of course race is a protected quality under the Equality Act 2010, and that has been taken to include Afro hair, cornrows, plaits and head coverings. Yet, since 2018, the Equality Advisory Support Service has had 50 calls about hair discrimination cases in schools. In 2020, the EHRC successfully funded Ruby Williams’s case, which resulted in an out-of-court settlement with no admission of wrongdoing over the exclusion of that pupil because of their Afro hair.
