On the point made by the noble Lord, Lord Anderson, who has made an important test, there are potential consequences following today. I think my noble friend Lord Carlile of Berriew—as I will call him, having known him for the best part of 30-odd years in both Houses—said that there may be consequences, but it is a matter for the operationally independent police to determine whether a charge is made on something such as a like on a tweet or a retweet, and it is for the Crown Prosecution Service to determine whether there is a case to be made, whether there is a crime and whether to put it to the courts for the jury to determine whether they have acted proportionately in doing that.
