Amendments 495D and 496D, in the name of the noble Lord, Lord Harper, would require that a person must apply to the commissioner for referral to a second panel within 10 calendar days of the refusal from the first panel. Given the short timeframe, these amendments may raise Article 6 issues if there is no discretion involved.
