I do not think that it is necessary to include in the Bill words to the effect suggested by one of the amendments from the noble Lord, Lord Murray of Blidworth: that the commissioner should not propose a procedure that is so irrational that no reasonable decision-maker would have adopted it. That is probably unnecessary. If he did adopt such a procedure, it would be set aside under judicial review. Remember that the voluntary assisted dying commissioner has to have been a former member of the Supreme Court or Court of Appeal, so he or she would probably be aware that that is not the right course.
