With Amendments 465 and 473, instead of the Bill saying that the panel must hear from the applicant or the doctor, the noble Lord, Lord Sandhurst, wants to specify that the panel must hear “evidence” from the co-ordinating doctor or patient. I am not at all in favour of that. It would not be appropriate to incorporate legal concepts of admissibility, which is what “evidence” connotes. It is for the panels to talk to the doctor and the patient to establish that the conditions are satisfied. We are not trying to create some pseudo-court.
