This, frankly, puts into question what the point will be of Parliament discussing what is likely to be an NHS Bill that will be put forward in the upcoming King’s Speech, when, regardless of what Parliament decides in respect of the NHS Bill in the next Session, the mechanism at Clause 41(6) could subsequently be used to undo all of that anyway. Surely the right thing to do is to specify in this Bill what the mechanism is supposed to be. Then, when Parliament subsequently passes further primary legislation for the NHS, if it wants to make some adjustments at that point, it can do so in the full light of day.
