First, for those without a disability, the Bill currently prescribes that no registered medical practitioner is under any duty to raise with anybody the subject of the provision of assistance in accordance with this Act, but nothing prevents a registered medical practitioner exercising their professional judgment to decide if and when it is appropriate to discuss the matter with such a person. Clause 5(5) provides, in relation to this preliminary discussion, that they cannot just raise assisted dying—it has to be in the context of the illness, the prognosis, the treatment and the palliative care. The Bill specifically identifies that it cannot be conducted in isolation from an explanation of the illness, the treatment options available or the palliative care available.
