If you ban a doctor equipped with all this knowledge about the patient and under the legal requirement from having to put the whole picture to the patient, you end up in a situation with, as it were, only those who know about it being able to access it. As the state of Victoria discovered after its five-year review, restricting any doctor from raising it, unless it is raised by somebody who knows about it already, had detrimental impacts on access in relation to it and was unfair to groups of patients. That is why, in the state of Victoria, they passed an Act in November—I am sorry that the noble Baroness, Lady O’Loan, is not in her place for this. That Act has not come into effect; it will come into effect in 2027, and it gets rid of the gag.
