This amendment (which needs to be read with Amendments 35, 36 and 37) is designed to ensure that the way the scheme administrator chooses to exercise the discretion under section 226B(5) of the Inheritance Tax Act 1984 where a lump sum death benefit is paid to a beneficiary does not affect the amount of the beneficiary’s taxable pension income that reflects the payment of that lump sum death benefit.
