The new definition of “inheritance tax” ensures that, where a beneficiary of a pension death benefit receives (directly or indirectly) a repayment of overpaid inheritance tax from HMRC, any accrued interest that was included in the overpayment and is repaid is treated as pension income for income tax purposes (in the same way as the repaid tax). The new definition of “non-qualifying person” is consequential on Amendment 40.
