239: After Clause 64, insert the following new Clause— “Right to take industrial action (No. 2)(1) The Trade Union and Labour Relations (Consolidation) Act 1992 is amended as follows.(2) Omit section 223 (action taken because of dismissal for taking unofficial action).”Member’s explanatory statement These amendments would remove section 223 of the 1992 Act which renders industrial action unlawful if one of the reasons for the industrial action is that the employer has dismissed one or more workers for taking unofficial industrial action.
