The transformation has been profound. Casting directories, which were once printed publications, are now sophisticated digital platforms, the function of which has evolved well beyond simply listing performers. They are now integrated marketplaces for casting, with extensive data handling, subscription models, and algorithmic search and matching functions. As my noble friend mentioned, in some cases they have tiered service offerings that may affect performers’ visibility and opportunities. Yet the key legal framework governing this space, the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations2003, was designed for a very different era. It is entirely reasonable to ask whether this framework still strikes the right balance of fairness, transparency and accountability for the performers using these platforms.
