I have not had a chance to look up Section 38 of the Employment Act 2002 for the effect of failing to give a statement in accordance with that section. I suspect that will either be some kind of civil penalty of criminal offence. I have not had the chance to look that up. I would love to hear from the Minister about what will happen if additional information is provided.
