248: Clause 99, page 127, line 8, at end insert— “(aa) in subsection (2), after the first row of the table insert—

“an offence mentioned in row 2B of the table in section 40(3)

the period of 2 years ending with the date of the offence or, if the tenancy ends before that date, the date on which it ends”;”

Member’s explanatory statement This provides that the amount of rent to be repaid under a rent repayment order in relation to an offence under section 16J(2) of the Housing Act 1988 is to be calculated by reference to the rent paid in respect of the two years prior to either the date of the offence, or if the tenancy ends before that date, the date on which it ends.
