This means that there is currently a peculiar disconnect in the licensing legislation, highlighted by the Chartered Institute of Environmental Health, whereby local authorities can introduce selective licensing schemes to address poor housing but cannot include in the licences themselves conditions requiring the physical state of the licensed properties to be improved. If they are permitted to do the former, what justification can there be for not permitting them to do the latter?
