41: Schedule 1, page 178, line 3, at end insert— “(6) Where an employment tribunal finds as described in sub-paragraph (5)(c), the hirer is to be treated for the purposes of section 12A and Part 2A of the Employment Tribunals Act 1996 (financial penalties) as an employer and as having breached the right of the agency worker to which the complaint under paragraph 25(1)(c) relates.”Member’s explanatory statement This amendment provides for provisions of the Employment Tribunals Act 1996 concerning financial penalties to apply in relation to a hirer who is added to proceedings under paragraph 25(7) of proposed Schedule A1 to the Employment Rights Act 1996 and who has a finding made against them in those proceedings.
