376: After Clause 142, insert the following new Clause— “Harassment of a person in their home(1) The Criminal Justice and Police Act 2001 is amended as follows.(2) In section 42 (police directions stopping harassment etc of a person in their home), in subsection (1)(b)—(a) omit the “or” at the end of sub-paragraph (i);(b) after sub-paragraph (ii) insert—“(iii) that they should not have done something they were entitled or required to do; or(iv) that they should have done something they were not under any obligation to do;”.(3) In section 42A (offence of harassment etc of a person in their home), in subsection (1)(b)—(a) omit the “or” at the end of sub-paragraph (i);(b) after sub-paragraph (ii) insert—“(iii) that they should not have done something they were entitled or required to do; or(iv) that they should have done something they were not under any obligation to do;”.”Member's explanatory statement This amendment expands sections 42 and 42A of the Criminal Justice and Police Act 2001 (protests outside homes) to cover protests about something done in the past.
