The Human Rights Act provides that a restriction that is necessary for the protection of the rights and freedoms of others is or may be legitimate. If this proposed new subsection were to in effect outlaw the application of the Human Rights Act, it would be operating as an ouster. It would be predetermining the very issue that the Human Rights Act requires to be considered before restrictions are authorised by law.
