382: Clause 154, page 205, line 6, at end insert— “(3) In section 76 (subordinate legislation), after subsection (5) insert—“(5A) A statutory instrument containing regulations under section 71 may not be made unless a draft of the instrument has been laid before and approved by a resolution of each House of Parliament.””Member’s explanatory statement This amendment provides for regulations made by the Secretary of State under section 71 of the Criminal Justice and Court Services Act 2000 (inserted by clause 154) to be subject to affirmative resolution procedure.
