The main issue that the noble Lord, Lord Young of Acton, has referred to is the prohibition of the disclosure of any historic records in enhanced disclosure and barring services that do not meet the new incident recording threshold and to require that such records be deleted. I note that the noble Lord has changed the deletion measure, because I think he recognises, having had the briefing that we arranged, that there is a big administrative burden in that deletion. I can tell him that non-crime hate incidents do not appear currently on a basic or standard DBS check. The Home Office is not aware of any evidence to suggest that there is a problem in practice with the disclosure of non-crime hate incidents on enhanced criminal record checks. Enhanced DBS checks are used only for sensitive roles involving work with children or adults.
