39B: After Clause 25, insert the following new Clause— “Duty to provide information to Secretary of State(1) An authority which is subject to a duty under section 25(6) or (Provision and design of floating bus stops)(7) (duties to have regard to guidance) must, when requested to do so, provide to the Secretary of State—(a) details of how they have complied with the duty, and(b) any other information relating to stopping places provided by the authority and used by local services that is specified in the request.(2) The request may specify the form in which, and the period within which, the information is to be provided.(3) The Secretary of State may publish—(a) any information provided under this section, and(b) if it appears to the Secretary of State that the authority have not complied with their duty under section 25(6) or (Provision and design of floating bus stops)(7), a statement to that effect.(4) In this section “local service” and “stopping place” have the same meanings as in the Transport Act 1985 (see sections 2 and 137 of that Act).”Member's explanatory statement This amendment requires an authority to provide the Secretary of State on request with compliance information relating to guidance about safety and accessibility of stopping places, or about floating bus stops. It allows the Secretary of State to publish the information and, if it appears that the authority did not have regard to the guidance, a statement to that effect.
