Online Safety Act 2023 (Category 1, Category 2A and Category 2B Threshold Conditions) Regulations 2025

I would be grateful to hear from the Minister what legal advice the department has had that allowed the Secretary of State to agree to Ofcom’s recommendation that it overrule the will of Parliament. If such advice exists, would she commit to making it available to noble Lords? If no legal advice was taken, would she commit to getting a legal opinion on whether categorisation as set out by Ofcom meets the meaning of the Online Safety Act as written and indicated by Ministers? Is the Minister prepared to say whether a regulator has the right to pick and mix on an Act that has received Royal Asset, and if it is not correct for the regulator to pick and mix, will she say what actions the Government will take in relation to the parts of the Act that Ofcom has chosen to ignore?
