While vaping is not risk-free, the available evidence on second-hand vapour suggests that the risks to bystanders are, at most, negligible when compared with second-hand smoke. That distinction matters. It is the difference between proportionate regulation and prohibition for prohibition’s sake. If the Government believe that exposure to vapour in particular places genuinely presents a material risk to health, they should have no hesitation in publishing the evidence that supports that conclusion.
