38: Clause 90, page 113, line 15, at end insert “in accordance only with the Commissioner’s duties under section 108 of the Deregulation Act 2015 (exercise of regulatory functions: economic growth).” Member’s explanatory statement This amendment ensures that the Commissioner’s duty to have regard to the desirability of promoting innovation is referable only to the duty imposed under section 108 of the Deregulation Act 2015. This amendment seeks to ensure that the Commissioner’s status as an independent supervisory authority for data protection is preserved given that such status is an essential component of any EU adequacy decision.
