37A: Clause 5, page 11, leave out lines 14 to 16 and insert— (b) there is a risk of serious harm to the health or safety of the patient or of another person;”Member's explanatory statement This amendment and others in the name of Baroness Murphy remove from the criteria any mention of “likelihood” or “may be caused” and replace them with wording that allows a clinician to evaluate risk in the individual case and give evidence more straightforwardly and comprehensively without making predictions for individuals about risk.
