266: After Clause 85, insert the following new Clause— “Guidance(1) The Secretary of State may issue guidance about the duty under section 77 to persons who engage in relevant activities.(2) Those persons must have regard to the guidance.(3) Before issuing guidance under this section, the Secretary of State must consult such persons as the Secretary of State considers appropriate.(4) The Secretary of State must publish any guidance issued under this section.(5) The Secretary of State may revise any guidance issued under this section.(6) Subsections (2) to (4) apply to revised guidance, except that subsection (3) does not apply if the Secretary of State considers that the revisions are not substantial.”Member’s explanatory statement This new clause provides for the Secretary of State to issue guidance about the duty to report child sex abuse.
