This is always the problem with criminal offences, which is why, on occasions, the Government have said that we want to urge caution before creating criminal offences when things that can be dealt with through regulation have a much wider reach. One drawback of criminal offences is that they typically apply only where prosecutors are able to establish UK jurisdiction. To provide some extraterritorial effect, we have ensured that Section 72 of the Sexual Offences Act applies to this offence, which will enable prosecutors to target overseas offending by UK nationals, bodies and associations.
