Amendment 496F would put in a necessary additional protection where there has been a reconsideration of a previous refusal. It would require the panel to show how each safeguarding concern identified in the initial refusal has been addressed, and that it is satisfied that the decision was free, informed and not markedly influenced by disability-related disadvantage in the plans. In a situation where a previous decision has said, “There are concerns, and the situation is such that there has been a refusal”, we have a safeguarding issue that we need to take into account. Particular care needs to be put in place there.
