Strong, effective and objective data protection enforcement is important to ensure that innovation results in products and services that benefit individuals and society; to ensure that important public programmes retain the public trust they need to operate; and to ensure that companies compete fairly and are required to improve safety standards. However, Clause 90 builds on the false assumption that objectives such as innovation, economic growth and public security would be competing interests and thus need balancing against data protection. By requiring the new information commission to adopt a more condoning and lenient approach on data protection breaches, Clause 90 could undermine the same policies it aims to promote.
