17: Clause 9, page 17, leave out lines 36 and 37 and insert—
“(5) The Secretary of State must not issue guidance or revised guidance under this section until after the end of the period of 40 days beginning with the day on which the draft was laid before each House of Parliament, or if it was laid on different days, with the later day.(5A) If, within that period, either House of Parliament resolves that the guidance or revised guidance should not be issued, the Secretary of State must not issue it.(5B) In calculating any period of 40 days for the purposes of subsection (5), no account is to be taken of any time during which Parliament is dissolved or prorogued or during which both Houses are adjourned for more than four days.(5C) The Secretary of State must publish any guidance issued or revised under this section.”Member’s explanatory statement
This amendment provides for the negative resolution procedure to apply to guidance under this section laid before Parliament.
