I was interested to read the amendment in the name of the noble Baroness, Lady Bakewell, and I listened carefully to the noble Earl, Lord Russell, make her argument. I agree with the noble Duke, the Duke of Wellington, that allowing some discretion over the making of rules under this section is attractive but if, as the noble Baroness would like, these rules were mandatory, it would be even more important that they were scrutinised properly.
