Lords amendment 4B would require the Ministry of Justice to publish an impact assessment before making any regulations. The Government fully recognise the importance of transparency. However, we do not consider that this amendment is appropriately framed in its drafting for the established process. Nevertheless, we recognise the strength of feeling about ensuring proper consideration of any future rates before these regulations are made. I am therefore pleased to say that we propose an amendment in lieu that we believe will formalise what the Government have already made clear throughout these debates: robust evidence, engagement with stakeholders and experts, and a careful assessment of impacts will underpin any use of this power.
