I want to understand this better for my own education, somewhat building on what my noble friend Lord Moylan has put forward in tabling Amendment 235. As it stands, Section 1 of the Mental Health Act 1983 provides quite a broad range of conditions that apply or can be determined. From reading other parts of that section and modifications to that Act, it could be that somebody is mentally impaired due to their alcoholism. It could be other aspects—not simply what might be considered with having schizophrenia or similar. I do not think it applies to somebody with dementia. I am trying to understand who this will work for and what the independent advocate will do.
