Does the noble and learned Lord, Lord Falconer, agree that only a senior psychiatric assessment, as asserted by the Royal College of Psychiatrists, can safely determine capacity in such circumstances; that the process of determining capacity should involve a multi-agency approach and the involvement of a member of family or friends; and that, therefore, the safeguards provided in the amendments should be accepted? These may be the kind of things that the noble and learned Lord is proposing to bring in the amendments that he places before the House.
