The problem, as this case shows, is that because the UK does not have presence-based jurisdiction, our courts are prevented from acting even when there are credible allegations and the individual concerned is present in the UK. Even without his special immunity, James Kabarebe could not have been prosecuted under the International Criminal Court Act 2001, as he is neither a UK national nor a resident.
